Top firms open to voluntary cybersecurity rules: Senate

WASHINGTON???Many Fortune 500 companies support the creation of federal cybersecurity standards to protect them from Internet threats like hacking as long as they are voluntary, according to a Senate survey of top U.S. chief executives released on Wednesday.?

The report resulted from letters sent to Fortune 500 companies in September by Senator Jay Rockefeller, the Democrat from West Virginia who last year authored a now-expired cybersecurity bill and is now renewing his push for such legislation.?

Better protection from cyber threats has taken on growing urgency in Washington, with top officials warning of the potentially devastating impact of cyber attacks that could undermine key infrastructure, which is mostly privately owned.?

Some 300 top companies in a variety of industries responded to the survey, according to the report compiled by the staff of the Senate Committee on Commerce, Science, and Transportation, which Rockefeller chairs.?

Reflecting that growing interest in better securing networks, computers and data from cyber attacks, the survey showed broad support of the effort to pass new cybersecurity laws and collaborate with the federal government. But the report also showed concerns that new standards would become mandatory, inflexible or duplicative.?

"The concerns raised about the legislation were not about whether the government should have a role with respect to cybersecurity, but about the specifics of that role and what impact that role would have on how companies respond to their cybersecurity challenges," the report said.?

One Fortune 500 company, for example, responded that it had "no fundamental concerns with a voluntary U.S. program if it is indeed voluntary, as opposed to a program developed from a regulatory or compliance perspective or by the unfortunate notion that companies should be required to disclose breaches or vulnerabilities." The quote was one of dozens cited in the report, which did not identify the firms by name.?

Similar concerns helped undermine Rockefeller's efforts last year, although his bill did propose a voluntary system of rules. In particular, the influential business lobby U.S. Chamber of Commerce vehemently opposed the 2012 cyber legislation.?

Wednesday's report sought to highlight some discord between the chamber's position and the generally positive comments from Fortune 500 companies about closer collaboration with the federal government and the need to update the current system, which has been criticized as ad hoc.?

The chamber's Ann Beauchesne, vice president of national security and emergency preparedness, reiterated the lobby's concern on Wednesday.?

"Voluntary standards sound great in theory, but the devil is in the details," she said. "Whether a new cybersecurity program is labeled regulatory or 'voluntary,' the fact is, government officials will have the final word on the standards and practices that industry must adopt, which the Chamber opposes."?

S.Africa's rand under pressure amid portfolio outflows

JOHANNESBURG (Reuters) - South Africa's rand struggled to regain strength on Wednesday after hitting a four-year low earlier this week and is likely to remain under pressure due to foreign bond holders exiting the market.

The rand was at 9.0434 to the dollar at 0643 GMT, slightly weaker than its close in New York on Tuesday.

Portfolio outflows of up to 4 billion rand from the bond market since mid-January have weighed on the currency, while labour unrest has also fuelled negative sentiment about Africa's largest economy.

"Portfolio outflows from the local bond market remain a real concern, given that we have seen 4 billion rand of outflows since mid-January," analysts at Absa Capital wrote in a note published on Wednesday.

"Further capitulation by these foreign bond holders likely would result in extended rand weakness and could create a reinforcing spiral for both the rand and South African bond market in the near term."

Government bonds continued to soften and the yield on the 2026 paper edged up 3 basis points to 7.495 percent while that on the 2015 issue was 2 basis points higher at 5.435 percent.

Australians clean up from floods; supplies dwindle

BRISBANE, Australia (AP) ? Military personnel headed to flood-ravaged northeast Australia on Wednesday to help clean up the sludgy aftermath of floods that damaged thousands of homes and businesses and left some communities short of power, food and water.

The death toll from the flood crisis rose to five Wednesday when police discovered a man's body in a car submerged in a creek. Another man who vanished while traveling through the same area earlier this week was still missing.

Floodwaters were receding in most places, bringing relief to a region that was battered by worse floods just two years ago. But there were concerns about food and water shortages in some communities and thousands were without power.

Around 120 soldiers were en route to the hardest-hit city of Bundaberg in Queensland, 385 kilometers (240 miles) north of Brisbane. The flooding, caused by the remnants of a tropical cyclone, forced around 7,500 Bundaberg residents from their homes, inundated 2,000 houses and 200 businesses with murky water and prompted helicopter evacuations of 1,000 people.

As the cleanup began Wednesday, some residents complained about dwindling food supplies.

"People were almost coming to blows this morning at the local shop fighting over bread rolls," said Chris Pasky of Moore Park, just outside Bundaberg. "We've got a baby in the house we can't feed. We've just been forgotten."

In Brisbane, residents were warned to conserve water after muddy floodwaters put pressure on the city's water treatment plants. Queensland Premier Campbell Newman told Australian Broadcasting Corp. that stocks of bottled water were ready to be distributed to residents if the reservoirs run dry.

In other areas, officials scrambled to deliver supplies to residents still cut off by the slowly receding waters.

"We're discovering people who are isolated, without power, without water, and we're going to be getting some long-life milk and bread supplies in through four-wheel drive later today," said Pam Parker, mayor of Logan City, south of Brisbane.

In a waterlogged area of Queensland, police have spent days hunting for two men, aged 25 and 34, who disappeared as they traveled separately to work on Sunday near Gatton, about 90 kilometers (55 miles) west of Brisbane. Police said they believed the body found Wednesday was that of the 34-year-old, though formal identification was still pending.

The hunt was still on for the younger man, whose car was found Tuesday in the same creek where the body was recovered.

Queensland residents suffered through the worst flooding Australia had seen in decades in late 2010 and early 2011, when floodwaters from heavy rain killed 35 people, damaged or destroyed 30,000 homes and businesses and left Brisbane under water for days.

Australia has been suffering through a summer of weather extremes, with blistering temperatures and dry conditions igniting hundreds of wildfires across the southern half of the country.

Egypt army chief warns state could collapse

CAIRO (AP) ? Egypt's army chief warned Tuesday of the "the collapse of the state" if the political crisis roiling the nation for nearly a week continues.

The warning by Abdel-Fattah el-Sissi, who is also defense minister, were the first comments by the powerful military since the country's latest crisis began last week around the second anniversary of Egypt's uprising. They came days after President Mohammed Morsi ordered the army to restore order in the Suez Canal cities of Port Said and Suez ? two of three cities now under a 30-day state of emergency and night curfew.

The attempts by Morsi to stem a wave of political violence appear to have made no headway as the country sinks deeper into chaos and lawlessness. So far, nearly 60 people have been killed in five days of unrest.

"The continuation of the conflict between the different political forces and their differences over how the country should be run could lead to the collapse of the state and threaten future generations," el-Sissi said in an address to military academy cadets. His comments were posted on the armed forces' official Facebook page.

On Sunday night, Morsi slapped a monthlong state of emergency and a night curfew on Port Said, Suez and Ismailiya, another city on the Suez canal.

Nevertheless, troops stood by and watched Monday night as thousands took to the streets chanting against Morsi in all three cities in direct defiance of the curfew just as it came into force for the first night at 9 p.m. The display of contempt for the president's decision was tantamount to an outright rebellion that many worried could spread.

Some of the demonstrators in Port Said waved white-and-green flags they said were the colors of a "new and independent state" in the city. Such a secession would be unthinkable in Egypt, but the move underlined the depth of frustration in the strategic city on the Mediterranean coast at the northern tip of the Suez Canal.

El-Sissi, who was named defense minister in August, acknowledged the difficult challenges facing his troops in the cities where they deployed.

"The deployment of the armed forces poses a grave predicament for us insofar as how we balance avoiding confrontations with Egyptian citizens, their right to protest and the protection and security of vital facilities that impact Egypt's national security," he said.

Morsi is the first freely elected president in Egypt. But since coming to office nearly seven months ago, he has failed to tackle the country's massive political, social and economic problems ranging from an economy in free fall to surging crime, chaos on the streets and lack of political consensus.

The wave of unrest has touched cities across the country since Thursday, including Cairo, the three Suez Canal cities, Alexandria on the Mediterranean in the north and a string of cities in the Nile Delta.

The violence first erupted Thursday and accelerated Friday when protests marking the two-year anniversary of the 2001 uprising turned to clashes around the country that left 11 dead, most of them in Suez.

The next day, riots exploded in Port Said after a court convicted and sentenced to death 21 defendants ? mostly locals ? for a mass soccer riot in the city's main stadium a year ago. Rioters attacked police stations, clashed with security forces in the streets and shots and tear gas were fired at protester funerals in mayhem that left 44 people dead over the weekend.

Bill Gates: Finance tax should aid world's poor - The Local

Bill Gates was the star attraction at a German Social Democratic Party (SPD) meeting in Potsdam on Monday, calling for world hunger to be fought with taxes raised on financial transactions.

SPD lead Sigmar Gabriel said at the meeting he stood behind the European Union plan to invest 0.7 percent of gross domestic product (GDP) in development policies.

Microsoft founder Gates, one of the world's richest men, has long focused his efforts on the Bill and Melinda Gates Foundation which funds health and education projects around the world.

He was invited to the Potsdam meeting of the centre-left SPD leadership meeting to talk with them about the foundation. He called for Germany and Europe not to abandon their contributions, despite the financial crisis.

Speaking ahead of the meeting Gates said the world was on the brink of great victories in the fight against illness and global poverty. "Germany plays a decisive role in enabling us to bank on success," he told the SPD paper Vorw?rts (Forwards).

"Development aid only counts for a fraction of public spending in most donor countries. Cuts in this area will not solve our budgetary problems," he said.

He said that great strides had been made in public health matters over the past 20 years - with the number of children dying before the age of five shrinking from 20 million in 1960 to less than 6.9 million in 2011.

But enormous differences remained. "We still have a long way ahead of us to ensure that every child that is born has the same chance of a healthy life regardless of whether it is born in a rich or a poor country," said Gates.

Frugal Honey: Cake and Personal Finance

This talk has been in the works for the past 2 months or so, with the idea spawned by friends asking me about financial matters and Lyn-Lyn's own mini-seminars with fellow Pinoys in the UK.

After setting the date and venue (thanks Kaka and Slice!) it was time to get my thoughts down and figure out how to make a poster and slideshow presentation.

Anyway, I tried to get my ideas across and I think I was able to convince some of them to finally try out investing at mutual funds and/or the stock market. There was a lot of laughter and sharing of experiences among the participants, so I'll have to say that Cake and Personal Finance was a success :)

Mark Salling shared a serious moment right in the middle of the Screen Actors Guild Awards arrivals with E! News Sunday night.

The "Glee" star, who with his castmates is nominated for best performance by an ensemble in a TV comedy, maintained his innocence when asked by E! correspondent Ross Matthews if he had anything to say about a certain story made headlines recently -- namely, that he was sued by a woman who's accusing him of sexual battery.?

"You hear about fraudulent lawsuits all the time," Salling said. "Until it happens to you, you really don't grasp what it does, not to just you, but to your family, and you want the legal process to happen as fast as possible, but just ... It takes time. I just want the chance to defend myself -- and I will, vigorously."?

"It's the first time for me," he added, when Matthews asked what it's like to all of a sudden be called upon to defend himself in that manner. "You kind of have to learn as you go, but like with anything else, you have to stay positive and count on the people that actually do know you and love you, and that you love, as well.?

Gauge of U.S. business spending plans edges higher

WASHINGTON (Reuters) - A gauge of U.S. business investment plans improved in December, a sign companies were betting the economy will pick up despite fears over tighter fiscal policy.

The Commerce Department said on Monday that non-defense capital goods orders excluding aircraft, a closely watched proxy for investment plans, edged up 0.2 percent last month.

Many economists expected businesses to invest more timidly late last year because of uncertainty over government spending cuts and tax increases, which had been scheduled to kick in this month. Congress ultimately struck a last-minute deal to avoid or postpone most of the austerity measures.

Despite the uncertainty, Monday's data pointed to growing economic momentum as companies sensed improved consumer demand.

"It certainly seems to us that companies are slowly but surely expanding," said Tim Ghriskey, chief investment officer at Solaris Group in Bedford Hills, New York.

In a further sign of business confidence, the November reading on capital spending plans was revised higher to show a 3 percent gain, up from the 2.6 percent rise reported a month ago.

A second report showed a measure of upcoming home resales took a breather in December, declining 4.3 percent. Still, the housing sector posted a rebound last year and economists expect it will add to growth again in 2013.

The business spending data pushed down prices for U.S. government debt, though stock prices also fell.

New orders for overall durable goods - long lasting factory goods from toasters to automobiles - jumped 4.6 percent in December, beating economists expectations of a 1.8 percent gain.

The gains were broad based, with orders for machinery, cars and primary metals all increasing.

"There's a lot more confidence," said Wayne Kaufman, an analyst at John Thomas Financial in New York.

Orders for civilian aircraft surged 10.1 percent. However, they could come under pressure in coming months as Boeing deals with battery problems in its new flagship passenger plane.

The manufacturer continues to make the 787 Dreamliner jet but stopped delivering them this month.

The planes list for about $200 million each and Boeing ships about five per month, so a sustained pause in deliveries could be a slight drag on overall shipments of durable goods, which last month totaled $230.6 billion. Lost shipments could also weigh on U.S. exports.

In December, core shipments of capital goods, which factor out aircraft and defense, rose 0.3 percent.

Despite the stronger-than-expected demand at the nation's factories, economists think economic growth cooled in the fourth quarter as companies slowed the pace at which they re-stocked their shelves.

Analysts polled by Reuters expect a report on gross domestic product due on Wednesday will show the economy expanded at a mere 1.1 percent annual rate in the fourth quarter, down from a 3.1 percent rate in the previous three months.

However, Monday's report on new orders for long-lasting factory goods suggested businesses are feeling stronger demand from consumers, and are responding by buying more machines to meet that demand. TD Securities economist Millan Mulraine said capital investment likely added to economic growth in the fourth quarter.

Nine Financial Resolutions For 2013 - Bad Credit Auto Loans

Less than a month into the New Year we offer up some tips from the Illinois CPA Society to strengthen your finances that also apply to consumers with poor credit

At Auto Credit Express we?ve spent the past twenty years helping car buyers with credit problems find those new car dealers that can give them their best opportunities for approved auto loans. Along the way we?ve tried to educate them on the high risk car loans process ? things we?ve learned from experience.

But we?re also not above passing on someone else?s good ideas when it comes to credit repair and managing finances, especially when they?re timely as well as particularly good. Point in fact: we came across an article by the Illinois CPA Society a few years ago and we?ve decided to share portions of it again.

Here are some excerpts from it:

Your Financial Fitness

The Illinois CPA Society recommends these nine resolutions to bolster your financial standing and keep it healthy.

1. Slim down your spending

Keep track of the amount of money you spend and take time to think about why you spend the amounts that you spend. Do you spend more when stressed, tired or hungry? Learn to avoid situations which might lead to overspending, and always think twice before buying. It?s not just how much you make but how much you spend that most influences your finances.

2. Be Honest

When estimating monthly expenses, consider typical monthly spending amounts. If you normally spend $300 on groceries, don?t write down ?$200? in your grocery category. Write down ?$300? and then aim for $200. Underestimating will get you in trouble.

3. Stick to a budget

Maintaining a budget and careful tracking of your spending are the only effective ways to keep tabs on your cash flow. Once you see where your money is going, you can make better choices on how best to spend less and save more. Resist the urge to abandon your budget, especially in the face of negative comments from friends and family.

4. Work off debt

Eliminating your debt can seem like an overwhelming task, especially if you?ve been shackled with it for some time. However, like all tasks, it starts with an action plan and small steps. First, you should outline a very specific strategy for accomplishing this goal. It needs to consist of more than ?I am going to spend less.? Second, consider using a credit counseling service or setting personal limits for your credit cards each month. Paying off your debt may end up taking more than a year or two, but having a clear action plan and asking yourself each day what you can do to reduce your dependence on credit cards will go a long way in making your 2009 finances more healthy.

5. Flex your money knowledge

Financial planning is a major step towards achieving financial security. It can help you become better prepared for whatever life throws at you. Make yourself aware of basic issues such as your net worth, when your debts need to be paid off, your retirement goals, and your capital needs to buy house/car/appliances. Get smart about your money and teach your children how to use it and save it.

6. Set Goals and Priorities

You will never hit the target if you don?t know what your goal is. Identify and prioritize your financial goals and when you would like to achieve them by. For instance, do you know when you want to buy a house and its cost, what it will cost you for your child?s education 20 years from now, or your retirement expenses 10 years from now?

7. Exercise caution and emphasize safety

Focus on creating a financial safety net; save for emergencies. Generally, you should have an emergency fund to cover six months worth of living expenses in the event you lose your job or suffer a serious illness.

8. Keep your records in shape

Keeping financial records in order can save you time, money and trouble in the event of an emergency. Have photos and videos of everything you own and keep them in a safe place. Store permanent records such as birth certificates, property deeds, insurance policies, wills, power of attorney and other important documents in a safe, fireproof location. Make sure your spouse, family and executor know where these documents are stored. Copies of these documents and other financial records should be kept in a clearly marked filing system in your home.

9. Get a Finance Coach

January is an ideal time to meet and develop a financial plan with your CPA advisor. Outline some short and long term goals together.

Apple's China dilemma: market share or cachet?

HONG KONG (Reuters) - Apple Inc's third straight disappointing quarter signals an urgent need for the global technology leader to drum up new revenue - and China may provide the answer.

Now more than ever, analysts say, Apple needs to get it right in the world's most populous country, where it ranks only sixth in annual smartphone sales and Samsung Electronics remains the runaway leader.

Apple's best plan of attack remains securing a deal with the country's top mobile carrier by far, China Mobile Ltd. It also needs to push the development of more localized apps and extend installment financing to bring its pricey smartphones within the reach of an urban populace with an average annual income of just $3,500.

But it should resist the temptation to just put out a cheaper iPhone, some analysts say. Introducing a long-rumored lower-cost version of the gadget could backfire by diluting Apple's premium brand - one of its most valuable assets.

"If you think of Apple, it's like a bright star in the galaxy, shining so brightly and everyone is looking at it. But it might have dimmed a bit as other stars such as Samsung have popped up," said TZ Wong, an analyst at research firm IDC.

"I don't think it's in Apple's interest to further dim its star power by stepping into the low-end segment."

With Apple's product pipeline guarded with the same zeal accorded state secrets, some analysts are focusing instead on what the world's largest technology company needs to do to finally become a major player in the world's No. 2 economy.

While iPhone sales leapt 60 percent last quarter, investors worry that, in the longer term, the company may be pricing itself out of a golden opportunity while Samsung and local rivals from Huawei Technologies Co Ltd to ZTE blanket the market with cheaper phones that rival the iPhone in quality and usability.

A deal with China Mobile, the world's largest mobile phone carrier with more than 700 million users, will prove instrumental but analysts say that may not happen until the issuance of 4G wireless licenses, which could take place later this year or even in 2014.

"The competitive landscape has definitely cranked up a few notches from a year ago. So there is more urgency for Apple to explore its ways to grow," IDC's Wong said.

CEO Tim Cook has made it no secret that China is an area of intense focus for the iPad and iPhone maker, especially given the still-low penetration across the country of smartphones and tablets. Apple has said it will continue to expand its retail network there, and in January, Cook flew to Beijing for at least the second time in a year, to meet with pivotal carrier China Mobile.

A STAR IS DIMMED

On Wednesday, Apple missed revenue forecasts for the third straight quarter after iPhone sales came in below expectations, fanning fears that its dominance of consumer electronics is slipping.

Apple's revenue in China, including neighboring Hong Kong and Taiwan, totaled $7.3 billion in the December quarter, up 60 percent from a year earlier.

But there are signs that Apple's vaunted cachet in the world's most populous nation is waning.

Recent product launches for the mini-iPad and the iPhone 5 have drawn a relatively subdued response from Chinese consumers, in stark contrast to the fist-fights and egg-hurling at its Beijing store a year ago when sales of the iPhone 4S were delayed.

Since the iPhone 5 went on sale in mid-December, transactions have fallen by half, according to the Taobao Index, the consumer research data website of Internet giant Alibaba Group.

The iPhone is also losing out as consumers opt for bigger screens to watch Chinese soap operas while travelling on trains, or affordable smartphones in the sub-1,000 yuan ($160) category made by local vendors.

"When I started using a bigger screen, there was no turning back for me. Small screens don't work anymore," said a business executive surnamed Wen, as he swiped the screen on his Samsung Galaxy Note during lunch in Beijing.

Around half of the more than 60 million smartphones shipped in China in the third quarter last year had screens that were bigger than 4 inches, based on IDC's latest figures. The iPhone 5 comes with a 4-inch screen, while the Galaxy Note II's screen is 5.5 inches.

Also, local vendors such as Coolpad smartphone maker Yulong Computer Telecommunication Scientific (Shenzhen) Co Ltd, which offers cheaper alternatives, and Meizu Technology Co Ltd, known for its minimalist designs, have seen its legion of fans grow.

Price is a key factor, especially in the Chinese market where around 80 percent of the more than one billion mobile phone users are still on 2G networks.

On the online Taobao website, Coolpads and low-end models made by Huawei Technologies Co Ltd and ZTE Corp are selling at below 1,000 yuan, a sweet spot for many consumers switching from basic phones to smartphones.

Apple has moved to address that, partnering with China Merchants Bank to offer financing and installment options so that buyers can pay with the bank's credit card when they shop online, media reports said.

Finally, expanding the number of applications customized for China will help grow Apple's market share but that might need tighter collaboration with Chinese companies, such as Baidu Inc and Tencent Holdings Ltd.

"Consumers will definitely welcome closer cooperation between Apple and Chinese tech firms to customize the iPhone for the use of apps such as Tencent's WeChat," said Frederick Wong, executive director of Avant Capital Management (Hong Kong) Ltd, a fund that invests in Apple-related options.

AT&T gains customers in 4Q, posts big loss

(AP) ? The launch of the iPhone 5 helped AT&T attract more new customers in the holiday quarter than it has in three years, but the company posted a big loss because of an annual adjustment to its pension obligations.

AT&T Inc. on Thursday said it added a net 780,000 new phones and other devices on contract-based plans from October to December, its best result in three years. It activated 8.6 million iPhones in the quarter ? a record for any company. AT&T was the first company to introduce the iPhone in 2007, and has more iPhone users than any other U.S. carrier.

AT&T's push to expand its market by getting non-phone devices connected to its network also helped, as nearly half of the new contract devices, or 380,000, were tablets.

However, AT&T remained well behind Verizon Wireless, the country's largest cellphone company. It added 2.2 million devices on contract-based plans to its network in the quarter, extending its lead.

Dallas-based AT&T's quarterly loss was $3.86 billion, or 68 cents per share. That compares with a loss of $6.68 billion, or $1.12 per share, a year earlier, also caused by an adjustment to pension and retiree benefit obligations.

AT&T provides benefits to about 360,000 retirees. Two years ago, it started accounting for its retirement benefit obligations with an annual fourth-quarter adjustment. That produces wild swings in fourth-quarter net income that don't relate to the company's underlying business, but do illustrate its large obligations to retirees.

Excluding the pension adjustment and some of the cost of repairs from Superstorm Sandy, AT&T earned 44 cents per share, 2 cents short of the average analyst estimate as polled by FactSet.

Revenue was $32.6 billion, up a hair from $32.5 billion a year ago. It slightly exceeded analyst estimates of $32.2 billion.

For the full year, AT&T said it was looking at expanding revenue by more than 2 percent and earnings per share by a "high single-digit percentage." The revenue forecast was slightly higher than analysts expected.

AT&T shares fell 2 cents to $33.73 in extended trading, after the release of the results.

The Wall Street Journal reported last week that AT&T was considering the possible purchase of a European cellphone company to take advantage of depressed prices and perhaps boost results by bringing U.S. business formulas to the continent. On a conference call with analysts, CEO Randall Stephenson neither supported nor ruled out the idea, but suggested that the company is looking at other types of international ventures, like partnerships and roaming agreements. He also noted that the company is licensing its Digital Life home security and automation technology to European carriers.

For all of 2012, AT&T earned $7.3 billion, up 84 percent from $3.9 billion in 2011. Revenue rose 0.6 percent to $127.4 billion.

Acronyms & Special Education - An Ethical Issue?

It pays to read those footnotes! ?I came across a doosey in a recent court decision. The topic involves acronyms.

In?B.R. ex rel. K.O. v. New York City Department of Education 60 IDELR 102 (SDNY 01/26/2012) footnote number one was a real killer. ?The court said as follows:

"?Unfortunately, '[t]his opinion, dealing as it does with the IDEA and practices thereunder, is replete with acronyms.'?M.H. v. N.Y.C. Dep't of Educ. (M.H. II),?685 F.3d 217, 223 n.l (2d Cir. 2012). One suspects that regulators and bureaucrats love such jargon because it makes even simple matters cognizable only to the cognoscenti and thus enhances their power at the expense of people who only know English. Nevertheless, acronyms have so invaded IDEA practice that this judge, like others before him, is pretty much stuck with having to use them." ? ?OUCH!

This indictment of acronyms reminds me of a panel I saw at one of the fabulous CADRE?conferences?a few years back. The panel was a success story type of panel - young successful adults who had previously been?special?education students. ?One criticism that was unanimous among ?the panel members was that special ed professionals use too many acronyms.

You know what they mean. ?IDEA requires that FAPE be provided in the LRE, using an IEP with a possible fba and a bip. Not to mention SLD, ODD, ED,ADHD, RtI, PT, OT...

But an interesting wrinkle on the topic acronyms involves an ethical dimension. ?A?speaker?at last year's NAHO conference suggested that the use of legalese in public documents is an ethical issue. He posited that people should be able to understand public documents. ?Is this?also?true of acronyms? ?Should we avoid the?acronym?trap in hearing decisions and procedural safeguards booklets? ?What are your thoughts?

Back in 1974, pop music artist Kiki Dee released the hit single ?I?ve Got the Music in Me.? The title of that song came to mind while talking to the man who has been credited with composing entrance themes for WWE Superstars for nearly three decades, Jim Johnston. We at WWE Classics wanted to find out what goes into creating a Superstar?s music, so we visited Johnston in his expansive Stamford, Conn., studios. Sitting comfortably around countless guitars, massive amplifiers and a grand piano, the musician revealed that his compositions always begin with a blank page.

?I?m relatively uninformed. A lot of times, I?m told there?s a new Superstar, and their name is ?blank,? ? Johnson explained. ?After that, it gets kind of sketchy, so I ask for some footage of the talent so at least I can see how they move. That?s always the starting point for me. A talent?s size and appearance go a long way to determining what I need to produce.?

Somewhat surprisingly, a Superstar?s persona is not a vital ingredient for Johnson?s creations.

?I think it?s good that I don?t get too much information, because it could easily take me in the wrong direction,? Johnson said. ?I try to react to what I see. I look at the footage and think, ?What?s this person really like?? If I feel something, I try to draw that out in composing their music.?

The one thing that Johnston rarely gets is input from the Superstars themselves.

?It can really confuse the issue,? he admitted. ?Many times a Superstar will tell me what kind of music they like to listen to, but that has nothing to do with what would be a good theme for them. I sort of approach it like a movie. These themes are a soundtrack to the movie of this person. It really has to do with the story.?

And after all these years, Johnston still finds composing Superstars? themes challenging. Sometimes the formation can be obvious, while other times it?s like figuring out the solution for a Rubik?s Cube.

?The whole process of composing is a mystery. I don?t really know where it comes from,? Johnson said. ?Sometimes I?ll sit down and something just shows up. As an example, ?Stone Cold? Steve Austin?s theme came really fast. I just picked up a guitar and played that groove. Very easy. It?s most difficult to me when an individual doesn?t have a lot of personality.?

Having learned a little about Jim Johnston?s craft, WWE Classics asked the musician to compose a list of his 10 favorite WWE Superstar themes. Needles to say, this was a very challenging proposition for him, to where the following themes (to name a few) made his ?honorable mention? list:

New research finds evidence that seeing individuals with different bodies, such as amputees or those born with residual limbs, causes the brain's motor network to work hard to process physical differences

A new USC study finds evidence suggesting that the brain works hard to understand those who have different bodies when watching them in action.

According to the study's lead author, the finding supports initiatives to include more individuals with physical differences in mainstream media such as Sarah Herron, a contestant on ABC's The Bachelor this season, who was born with a foreshortened left arm.

"Generally, it's considered impolite to stare. But what these results suggest is that we need to look. It's through this visual experience that we're able to make sense of those different from ourselves," said Sook-Lei Liew, who is the lead author of a paper on the research that appeared online this month in NeuroImage.

Liew, now a postdoctoral researcher at the National Institutes of Health, completed the research while she was a doctorate student at USC, working with Tong Sheng, a fellow graduate student, and Lisa Aziz-Zadeh, an assistant professor at the USC Dornsife Brain and Creativity Institute and the Division of Occupational Science and Occupational Therapy.

Liew, Sheng and Aziz-Zadeh monitored the brains of 19 typically developed individuals using functional magnetic resonance imaging (fMRI) while showing them a series of video clips. First they showed a typically developed person picking up objects and then a woman born without complete arms using her residual limbs to perform the same tasks.

The fMRI scans showed that parts of the motor network responsible for picking up objects by hand are activated when simply watching another person performing the task physical evidence of participants attempting to use their own body representations to represent the people they are watching on screen.

The thing that surprised the researchers was that same part of the motor network was activated to a greater degree when watching residual limbs doing the same activity. Participants' brains worked overtime to process the use of a type of limb that they did not have.

"Interestingly, we found that individual differences in trait empathy affected the result," Aziz-Zadeh said. "That is, individuals who scored higher in their ability to empathize with other people showed more activity in motor regions when observing actions made by residual limbs."

Further, when shown more clips of the woman with a residual limbclips that lasted minutes instead of secondsthe fMRI scans showed similar motor network activity, which returned to a level comparable to when they were watching typically developed individuals, suggesting that increased visual exposure improved understanding.

"Stigma is one of the main challenges for people with physical differences," Liew said. "We need to examine why stigmas exist and what we can do to alleviate them. Learning about disabilities visually is one way that we can begin to map their experiences onto our own brains."

AT&T to pay $780 million for rural wireless assets

(Reuters) - AT&T will pay $780 million in cash to acquire Atlantic Tele-Network Inc's U.S. retail wireless operations operating under the Alltel brand, AT&T said on Tuesday, announcing a move aimed at boosting its service in rural areas.

Atlantic Tele-Network shares rose 11 percent after the news was announced on Tuesday.

The Alltel brand serves about 585,000 customers in mostly rural areas in the states of Georgia, Idaho, Illinois, North Carolina, South Carolina and Ohio. AT&T said the spectrum it is buying is complementary to its current network.

It said it does not expect the deal to result in "significant" dilution to earnings per share or hurt cash flow.

After AT&T's bid to buy Deutsche Telekom unit T-Mobile USA for $39 billion failed in late 2011, the company has sought other ways to meet growing demand for data services from smartphone users by expanding spectrum holdings to improve network capacity.

AT&T expects the deal, which is subject to review by the U.S. Federal Communications Commission and the Justice Department, to close in the second half of the year.

After the sale, Atlantic Tele-Network will have still have telecom operations in the U.S. Southwest, New England, New York State, Guyana, Bermuda and portions of the Caribbean islands.

In August, AT&T agreed to buy NextWave Wireless Inc for $50 million and $550 million in debt assumption.

On January 17, AT&T said it will take a fourth-quarter charge of about $10 billion due to bigger-than-expected pension obligations. It also expects to take a $175 million reduction in operating income because of infrastructure damage inflicted by storms including Superstorm Sandy.

Shares of Atlantic Tele-Network rose $4.34 or 11 percent to $43.71 in morning trade on Nasdaq. AT&T shares rose 4 cents to $33.48 on New York Stock Exchange.

Who wants Valverde?

Now that he?s found a taker for Rafael Soriano on a heavily deferred deal, Scott Boras is trying to get teams interested in ex-Tigers closer Jose Valverde.

Valverde, 34, was 49-for-49 saving games for the Tigers in 2011 and 35-for-40 last season, but the postseason meltdown that saw him give up nine runs in 2 2/3 innings, combined with some declining peripherals from the regular season, has scared away seemingly every team this winter.

Boras knows he can?t use words to sweep away Valverde?s October struggles, but he does cite workload and fatigue as a possible reason for the sudden swoon. Counting the postseason, Valverde appeared in 81 games in 2011 and 75 last season.

?Closers normally have anywhere from 58 to 62 appearances and Valverde?s just had two years where he was used a lot,? Boras told George Sipple of the Detroit Free Press. ?It was a very unusual year this year, because he had so many non-save situations. He had like 31 of them, which normally they only have 17 or 18. So, it was a very unusual year.?

Those non-save situations are another thing working against Valverde this winter. He has a history ?of struggling without a save on the line, so contenders aren?t looking at him as a potential setup man.

Realistically, Valverde is going to have to settle for a cheap one-year deal with a chance to rebuild his value. If he?s willing to sign for $2 million or so, then maybe the Mets, Astros, Marlins or Twins could give him the chance to close. There?s certainly no reason to give him anything more than that, not with Brian Wilson, Francisco Rodriguez, Matt Capps, Jon Rauch and Francisco Cordero all sitting around waiting for phone calls, too.

(AP) ? Algerian forces scoured the Sahara Desert on Tuesday, searching for five foreign energy workers who vanished during a chaotic four-day battle with hostage-taking Islamist militants.

One official says the men may have fled the sprawling complex during the fighting and gotten lost.

The four-day confrontation that began when al-Qaida-affiliated militants stormed the remote desert natural gas complex and took hostages early Wednesday, was punctuated by exploding cars, attacks from helicopters and a final assault by Algerian special forces.

In all, 37 hostages, including an Algerian security guard, and 29 militants were killed, but five other foreign workers remain unaccounted for.

"Are they dead? Did they attempt to flee the site after the attack like some other expatriates? Are they lost in the desert after taking a wrong turn?" an official who is part of Prime Minister Abdemalek Sellal's office told The Associated Press. "These are all questions we ask ourselves, but one thing is sure, everything is being done to know their fate."

The official spoke on condition of anonymity because he was not authorized to speak to the media.

The Ain Amenas gas plant, jointly run by BP, Norway's Statoil and the Algerian state oil company, is located deep in the Sahara, some 800 miles (1,300 kilometers) south of the Mediterranean coast, with few population centers nearby.

More than 700 people work at the facility, including 130 foreigners from 26 countries who were targeted by the militants. The Islamists caught as many of those foreign workers as they could and wrapped some with explosives to use as human shields.

Many foreign and Algerian workers hid and then slipped out of the sprawling facility into the hard featureless desert, eventually reaching the Algerian soldiers who had surrounded the complex.

This part of the Algerian Sahara has none of the romance of the rolling velvet dunes of the Grand Erg Oriental to the north or the wild, twisted rock formations of Tassili N'Ajjer National Park farther south. Instead it is flat, dry and bitterly cold in the winter, with temperatures dropping to 3 degrees C (37 degrees F) at night.

The hostages could also have died in the fiery shootouts at the plant after being draped with explosive belts. Seven of the bodies recovered have yet to be identified because of their degraded condition, authorities said.

The $2 billion natural gas complex, which came online in 2006, was showing signs of life again Tuesday. Dozens of workers swarmed in to clean it up after experts went through and removed explosives that had been planted by militants.

The site was still littered, however, with the burnt-out carcasses of dozens of four-wheel drive vehicles destroyed in the clashes.

"I observed the damage and it isn't very serious," Algerian Energy Minister Youcef Yousfi said Tuesday in a visit to the site, according to the APS state news agency. "Once the damage has been evaluated, we will replace the equipment."

He said the plant, which provides 18 percent of the natural gas that is such a key Algerian export, would be brought back on line as soon as possible.

The audacious attack showed the improved capabilities of al-Qaida-linked groups in the Sahara. Some 32 militants ? coming from across North Africa, with two from Canada ? participated in the attack. Three were captured and the rest killed. Algeria said the group came from northern Mali, hundreds of miles away, sneaking across the borders of Libya and Niger before finally entering Algeria.

A group called the Masked Brigade claimed responsibility for the attack, saying it came in retaliation for Algeria's support of a recent French military operation against Islamist extremists in northern Mali and promised further such attacks. The group said the operation was two months in the planning.

Yousfi maintained that "Algeria had the means to secure our installations" and expressed doubt that any foreign companies would leave the oil-rich nation that is the third-largest supplier of natural gas to Europe.

Geoff Porter of North Africa Risk Consulting said the attack had sent shockwaves through the foreign oil and gas companies operating in Algeria and put them into a crisis mode.

"For the immediate term, this means that the Algerian hydrocarbons sector will enter a holding pattern for the next month or so, possibly resuming meaningful activity at the beginning of March," he said.

But he agreed with the minister that "it is extremely unlikely that Algeria will witness a mass exodus of foreign oil companies."
